No one else would like to comment on the tale of The Curious Case of the Never-ending book.  We've only had Pogue and Shayne so far, and I'm interested in others' opinions as to what course of action should be taken.

bk, this is the kind of thing that drives librarians crazy!  We order something, put it in our catalog, start building a reserve (waiting) list, the title changes, changes again, and again, and when we can't supply the book to our patrons they get mad at us.

As for the specific case, I'd contact the attorney general in the state from which the individual does business.  Or I'd ask for interest on my "investment."

It has just been an ALL-STAR BIRTHDAY BONANZA lately, but how can one day alone be reserved for two of the HHW MVPs?? It's not enough!!!

Jose: (as you folks will see when you come out in Oct.) just walks down the street and makes new friends and runs into old ones every two blocks. A champion!

JRand: A hilarious dude and fellow Hoosier with that great Indiana sense of humor and the choreographic machinations of a mad genius (so I hear). Also a champion!

I am thinking about writing a book someday.  I have a couple of good ideas.  If you  will l just send me $500.  I will make sure that your name is prominently displayed on the dedication page.  For $1000 you will also be acknowlegded in the preface.


I plan to start writing this book whenever I get some time.

Now, as to this BOOK DEBACLE, I recall BK talking about this during his last visit here, and I can't believe it is still going on.

The reaction is, "Ain't there laws to stop this kind of thing?" It seems to me most ads for products give people a window of time: "Items deliver in 6-8 weeks," that sort of thing. That window of time may be a requirement. How this works with pre-orders I do not know.

But if people are speculating on the internet that this may be his downfall, they need only amass in number and contact the State ATTORNEY GENERAL of whatever state out of which he is doing business. It would only take a few calls to get them interested. Once you call, they usually ask you to put your claim in writing. It would be nice if someone has printed out the various songs and dances this guy has spun over the last few years. Including the longwinded emails while he was supposedly slaving away.

The sad part is, what people really want is the book. Whether this was a planned scheme or the guy just got in over his head, I don't know. But what he is doing is wrong. Someone needs only marshall the forces of those who've been burned, and at the very least, have a lawyer draft a letter from concerned parties.

In my CD player at work:  Sergei Rachmaninov's Symphony No. 2 in E minor, Op. 27, Vladimir Ashkenazy conducting the Concertgebouw Orchestra, per BK's recommendation.  It is quite beautiful.  And BK is absolutely right about the third movement (the Adagio).

In my VCR:  tapes of shows from the last couple of nights that I haven't had time to watch, yet.

In my DVD player:  "Bells Are Ringing" and a couple of other new things that I can't remember off the top of my head.

Yes, I can ask for my money back, and yes, from what I understand from others who have done that, is that it will be forthcoming.  But, as Ginny mentions, shouldn't there be interest on the money?  Certainly, HE'S been continuing to earn interest.  Some people think he's spent the money and simply cannot afford to print the book.  I have no idea if that's true or not, but certainly the speculation has been made.  The other option, of course, is to contact the Attorney General of his State.

The problem of course is that the people who sent the money REALLY want the book - but they bought something that doesn't exist.

Yes, the AG of his home state should be contacted.  Ask for the Fraud Division.  They will send you a form....or most likely this can be done at the website for the State.  I know Indiana has an online form.  

Well worth looking into.  This is a fraud, plain a simple.  Not even a bait and switch.  And hopefully someone has copies of the ads.  The progression should make the swindle clear to the authorities.

My CD player still has the same CD's that have been in there for the past two weeks.  Been listening to CHAKA KHAN and CELINE DION a lot on my ipod, though.

As to the case of the never-ending book, I haven't practice as a lawyer in years, and I don't know what state the culprit is in, but based on what I learned in law school over two decades ago, in most states, there needs to be damage for someone to sue.  Meanwhile, it sounds like everybody who's asking for their $97 to be returned is getting it back, so who can claim damge, except for mental discomfort?  As to the interest on the $97, the interest rates have been so low that even for people who paid their $97 five years ago, we're talking damage of less than $10 per person.  Has anyone actually asked for interest on their money and been refused?  (The foregoing, I must hasten to note, is not legal advice, just an analysis based on what I remember from years ago.  :)  )

Bruce if you ask for your money back and get it, that’s it.  Frustrating yes but not worth pursuing any farther.  Even if you could take legal action, which I expect would cost more than the interest lost, at the time you ordered you were aware of the history of this book so I doubt you would have much of a case.

It does make for an interesting column so you got something out of it. :)

MR BK - DR FJL and DRJANE are probably right.  Said "author" has probably put himself on secure legal ground.  There have probably been others of the 1000 people who have also threatened him....to produce....something!

Bad publicity is the WORST harm you can do him....so go for it.
