I'm waiting for Edith to get to the office so we can leave for Omaha.   It's supposed to sleet and maybe freezing drizzle so even though I told her 8:00 AM I was really hoping she'd be here sooner.   Oh well, we'll do what we can do.

My tv also new that LOST was going 2 minutes extra and that TOP CHEF was going long.

I think it depends. Because FOX keeps going 1 minute over  on AMERICAN IDOL and its not marked. So my tv doesn't know to record it.

I'm awake.  Today should have been in the classroom, instead, it's off to the Honda dealership to take care of an issue that happened while on the highway yesterday.  The car (a 2003 Honda Element) decided to lose power at about 55 mph.  This has happened before, and it is a subtle (NOT!) reminder that the oil may be low  So, I but a few quarts in, checked the level and it's still doing the same thing.  So, since it is my livelihood, it's going to the shop.  Hopefully, it's nothing major.

I'm guessing DR Jose was happy to see his twitter friends on the show last night! I was really unhappy with the elimination method. The 3 worst chefs (carla, leah, hosea) all won their rounds. And 3 of the 4 best chefs (fabio, stefan and jeff all lost). I was really mad because those 3 were really good. Not happy one of them had to go home. I"m not crazy about stefan's attitude sometimes but he is a great chef. And my favorites were jeff and fabio (although i think jamie is great too just not my fav). The Superbowl idea was good. Got some glorious news today from my Time Warner cable company.

After a year of HEAVY prodding via many, many e-mails, I got the news that the following HD channels would be added in February:

USA HD
Sci Fi HD
CNBC HD
Bravo HD


I simply could NOT be happier!

That makes the only other cable channel that I watch regularly - FX - will be the only one without an HD component in my cable listings. Hopefully, that, too, will only be a matter of time.

Thursday morning greetings!  DH Richard is outside trying to de-ice his car, which has been parked on the street since Tuesday afternoon.  Once he got the snow off, he found a layer of solid ice encasing the entire car.  Good thing I fortified him with a breakfast of pecan waffles and bacon!

Today I'll be starting on the second season of DAVE'S WORLD for my work assignment. There are 26 episodes, so it'll take a good two days to get through them all. Having never seen the show, I have only a vague notion of what I'm in for. Seems like it might be fun though there are only three actors in the cast that I'm at all familiar with.

Doing a little research, I noticed that DAVE'S WORLD was CBS' second most popular comedy during the 1994-95 season that this box set represents. (MURPHY BROWN was still CBS' top-rated sitcom.) But NBC and ABC had many more popular comedies at the time: HOME IMPROVEMENT, GRACE UNER FIRE, and ROSEANNE on ABC, FRASIER, FRIENDS, SEINFELD, and MAD ABOUT YOU on NBC.

Well, I guess I went for the wildly patterned double knit polyester/bell bottomed trouser fad of the 1970s (though you couldn't find much else in stores except for jeans and khakis). I never did the platform shoes, though. I stayed in loafers and side-zip boots during those years.

I just read that due to the digital switchover, February sweeps this year are going to take place instead in March, so expect a fair number of reruns in February this year and lots of new episodes in March instead of the other way around.

TOD - As a young administrator, I totally bought into the John Molloy women's "dress for success" fad.  I had a wardrobe of skirted suits, button-down shirts, and little bow ties that all went out the window when I had to replace them with maternity clothes.

The continuing saga:

Last Thursday two very fast women packed up most of my stuff and on Friday a crew of very strong men put it all into two massive trucks to go into storage for God knows how long. On Saturday and Sunday Matt helped me do a major cleaning. I grossly underestimated how long it would take to empty the remaining cabinets of the stuff that doesn't go into storage. I was mopping the kitchen floor last Sunday night. I am NOT a last-minute person and thought I'd have some leisure over the weekend. Ha! But I managed to pack my car to the brim, believe me, plus Matt took a number of boxes to UPS to send directly to California.

I did Season One of this show several months ago and quite enjoyed it.  Just so's you don't get hate mail, Season One at least had replaced the original music (Billy Joel did the theme on the original broadcast version).

LOL, DR Jeanne!  "Out the window" was purely a figure of speech, as some of those suits are still in a closet upstairs.  I should pack them up and give them to Clothes that Work, a Dayton nonprofit that gives workplace appropriate apparel to those in need.

Are you getting some well-deserved R & R in Florida?

The Auto Train was an interesting experience. I've taken Amtrak many times, but had never taken the Auto Train. I met a very feisty octogenarian and had fun chatting with him.

DR Jennifer - I knew that both Andrew and Spike would be on last night.  They've been featured in the commercials for the past week, and Spike mentioned it too at the end of last week's Twitter session.  The surprise this week: Carla had stopped by Spike's place, Good Stuff Eatery, to watch the show with Spike and company.  (Andrew was also Twittering last night, but from his place in NYC.)  Well, after it was revealed that Carla had won the Quick Fire Challenge, that's when she surprised her husband with the Super Bowl tickets!  I guess I know where they are going this weekend.  -And I guess that also shows just what kind of secrecy clause the contestants have to sign.  As for the eliminations, well... I've never really liked Jeff, and I could tell from early on that his fussiness would be his downfall.  Simplify, simplify, simplify. He also just never seemed like a true fighter to me.  But that could be just me.

As for last night's bottom three, just remember, each contestant should always be on their "A Game".  They all cooked bad dishes, and thus ended up in the bottom three.  -And it's nice to see that the judges are really trying to stick to "only judging them on this challenge".  But a part of me also thinks that Fabio was kept on for his entertainment value.  Although, since he was so heavily featured this week, he will most likely be going home next week. *I''ve taken the Auto Train before too, and loved it. Very civilized, and I liked making new "friends" at the dining tables during the meal service.

I am afraid the last round of chemo combine with the continued readiation
really hit me hard this time. Vixtdad had been with me fulltime since MLK Day,
until Tuesday today have we felt secure enough to allow him to go back to work.

Fortunately for me this week is midterm week for Vixter so no school unless
she has a test and she had no test Tuesday so she was home all day with me.

The radiation burns in and out of my mouth and throat have become very
painful.  I find speaking painful and I have not successfully kept anything
in my stomach except Pedialyte from Friday until yesterday.

Monday Vixdad took me in for a hydration at the chemo DR and the IV helped perk me up some.  I had another IV yesterday, (my Dad drove me) and possibly Monday if I need it

The good news is I am DONE with radiation treatments and the Chemo is
DONE!!

Hopefully I will begin recovering from the side effects shortly.



The very, very good news that they believe they have successfully treated the cancer and I will be OK moving forward.  Of course we will be having
continuing checkups and tests but all the doctors are very optomistic

I am sorry for not answering all the individual emails but just typing this
has been exhausting.

Thank you all for your prayers, your calls, cards etc...I cannot express to
you fully how much it all has meant to me


Edi your bell has been a Godsend as I simply cannot speak above a whisper and only a few words at a time because of the throat pain.

I have a conundrum and it requires me revealing the new Kritzerland release (replacing Lady Oscar) - I need opinions.

For those who have Laurette, you know I love incidental music from plays and our next release (not for publication) are two incidental scores from plays, including what is considered to be the most classic 20th century play.  That music is composed by a major film composer who also did the film version of the play.  The second score is by one of my personal favorite composers (composed one of the best scores of the 1960s) to a play based on a famous foreign story and then classic film.  Now, the music from the classic play had to be mastered from acetates, which is all that was available (at least that I could locate - who knows what might turn up some day, although I would doubt a tape source would ever turn up, unless it was just acetates put on tape).  The acetates, which appeared to be in okay shape, were just very very noisy, had a little groove distortion, etc.  The mastering guy did a really good job cleaning it up, but, after listening to it last night, it's still sounds a little dicey to me.  So the question becomes does history outweigh sound issues?  The intention was at make this a 15.98 release like Laurette and the first Herrmann, both of which came from acetate or vinyl sources. 

The problem with this one is that, unlike Laurette, there are only five or six instruments, so it's easier to hear the problems.  But the music is wonderful - the second score is in stereo and will sound fine.  And the CD will run over sixty minutes.  Please let me know what you think.

She never convinced me to go, and I didn't like being around her when she was doing it because she felt compelled to tell her friends what they were doing wrong in their lives and trying to "fix"them using forum methods. I'm actually listening to it (I burned a copy from iTunes) and it's better than I thought - a little noisy at times but he really did a good job, especially if you heard what he was working from.  I think it'll be fine.  $15.98 is about the lowest I can go and make any dough at all, especially because this mastering charge is going to be really high.

Car will remain in the shop until tomorrow as they have to order a switch.  Hopefully, there isn't any transmission damage.  I have a rental for now, hopefully just for a day.  I will not complain... in 6 years of having the Honda Element, I have not had ONE major thing wrong with it.  It's been very faithful.  A little TLC might be what it needs at this time.

I'm guessing DR Jose was happy to see his twitter friends on the show last night! I was really unhappy with the elimination method. The 3 worst chefs (carla, leah, hosea) all won their rounds. And 3 of the 4 best chefs (fabio, stefan and jeff all lost). I was really mad because those 3 were really good. Not happy one of them had to go home. I"m not crazy about stefan's attitude sometimes but he is a great chef. And my favorites were jeff and fabio (although i think jamie is great too just not my fav). The Superbowl idea was good. I can't say i totally loved last night's show. It was weird having no jack or kate. I miss sun and jin together. I hope they show him again (if he is still on the show). It's weird with so few people on the island. I am loving desmond and penny and little desmond. That was interesting to find out. I guess the surprise of the show was meeting young charles widmore. I was not expecting that at all. I'm not sure i like the flashes. It makes you realize that no matter what danger they are all in that they will be fine during the next flash. I think if the oceanic 6 get back to the island it might get more interesting. Although what will happen to locke's body?Btw did most people assume little desmond was named after charles widmore and not dead charlie? For some reason i forgot about dead charlie!

I am afraid the last round of chemo combine with the continued readiation
really hit me hard this time. Vixtdad had been with me fulltime since MLK Day,
until Tuesday today have we felt secure enough to allow him to go back to work.

Fortunately for me this week is midterm week for Vixter so no school unless
she has a test and she had no test Tuesday so she was home all day with me.

The radiation burns in and out of my mouth and throat have become very
painful.  I find speaking painful and I have not successfully kept anything
in my stomach except Pedialyte from Friday until yesterday.

Monday Vixdad took me in for a hydration at the chemo DR and the IV helped perk me up some.  I had another IV yesterday, (my Dad drove me) and possibly Monday if I need it

The good news is I am DONE with radiation treatments and the Chemo is
DONE!!

Hopefully I will begin recovering from the side effects shortly.



The very, very good news that they believe they have successfully treated the cancer and I will be OK moving forward.  Of course we will be having
continuing checkups and tests but all the doctors are very optomistic

I am sorry for not answering all the individual emails but just typing this
has been exhausting.

Thank you all for your prayers, your calls, cards etc...I cannot express to
you fully how much it all has meant to me


Edi your bell has been a Godsend as I simply cannot speak above a whisper and only a few words at a time because of the throat pain.

The next time we are invited to a charades game the oter folkds better watch out!  Vixdad & Vixter have become expert at interpreting my signs

Yes today was the LAST DAY!!! The radiation doctor met with us this morning  and is very, very pleased with the results - he said I responded excellently to the treatment.

 I will have follow up appointments with the Chemo Oncologist and the surgeon next week but right now it looks like it will just be the road back.

 I have been warned that  recovery is going to be slow so it may still be some time before I can speak on the phone again. 

I have been so very very blessed to have the support and prayers of so many people including my boss and Vixdad's boss who has been super understanding about allowing him to stay home with me with little or no notice.

We really have been lucky in that the radiation where I had to go every morning was only 15- 20 minutes from home, a new facilty that only opened this past August. 

The people there were truly wonderful - from the first phone call until today I was always greeted by name, with a smile and they always took immediate action to handle any issues that arose - they were absolutely the best.



 I am feeling a bit stronger today and the food is staying put!

 The Vixter gets to go away this weekend with her church group for a "retreat" in CT.  It will be nice for her to relax and just be a kid again for the weekend and for Vixdad and I to have some alone time.

Got some glorious news today from my Time Warner cable company.

After a year of HEAVY prodding via many, many e-mails, I got the news that the following HD channels would be added in February:

USA HD
Sci Fi HD
CNBC HD
Bravo HD


I simply could NOT be happier!

Congrats!  Here in western Washington, we have USA and SciFi in HD, but not CNBC or Bravo.

I just read that due to the digital switchover, February sweeps this year are going to take place instead in March, so expect a fair number of reruns in February this year and lots of new episodes in March instead of the other way around.

How is this going to work out with March Madness basketball games being televised on CBS?

Those games score very well in the ratings, so I'm sure CBS will be delighted that the games fall during ratings sweeps. Where's the problem? They'll air the same schedule of new shows and repeats of their series as they would have done otherwise.

I'm awake.  Today should have been in the classroom, instead, it's off to the Honda dealership to take care of an issue that happened while on the highway yesterday.  The car (a 2003 Honda Element) decided to lose power at about 55 mph.  This has happened before, and it is a subtle (NOT!) reminder that the oil may be low  So, I but a few quarts in, checked the level and it's still doing the same thing.  So, since it is my livelihood, it's going to the shop.  Hopefully, it's nothing major.

TOD I was in collge when the pet rock craze hit - a friend of mine who worked  in the theatre dept as assistant for the Theatre Director has a pet rock - I remember it had a boolet warning againt collecting potentially dangerous "wild rocks"  we took great delight in leaving meancing wild rocks on his desk while he was away - one I remember I left  his rock tied to a pencil and circled by a group of bigger rocks, one of which had a matchbook taped to it

One thing I've learned from watching LOST for 4+ years, why worry about anything not making sense or not adding up when there are SO many pieces of the puzzle still to come? When the series concludes at the end of next season, THEN I'll worry about things not adding up or things unexplained. Until then, I'm on the roller coaster ride of a lifetime, and I'm LOVING every second of it.

And as I said last night, the show's pace was so rapid for me last night, the episode ended and then I remembered that there had been no Jack, Kate, Hurley, etc. Sure, I love those characters, but there was PLENTY to keep me occupied and interested last night.

I watched five episodes of DAVE'S WORLD this afternoon, the first episodes of the show I have ever seen. It's a mildly pleasant domestic comedy, but the performances are pitched a little high for my taste. Except for the cute, dense stud muffin (Kenny played by Shadoe Stevens) who's more low key, everyone's loud and overplayed.

Can we forget the Rrubik's Cube?

I had a Rubik's Cube.  That's probably the only fad that I can think of that I took part in.  When I was a senior in high school, I took wood shop and actually made a wooden Rubik's Cube!  My friend Andrew gave me the middle part of one and I made technical drawings of the pieces and cut and carved them from wood.  I didn't paint the sides different colors, though.  I just used a natural wood stain.  I didn't care how good it turned out (it's FAR from perfect), the idea was just to see if I could do it...and I still have it!  If I remember, I'll take a picture tonight. :D

I posted a couple of days ago that I had ordered GOODBYE, MR. CHIPS, FAR FROM THE MADDING CROWD, and THE YELLOW ROLLS-ROYCE from Deep Discount and had not even received a shipping notice from them even though the discs came out on Tuesday.

Today they arrived in the mail. Don't know why DD never informed me they were on the way, but I was nevertheless delighted to get them. Now, I get to stare at them in their shrink wrap until such time as I get a free evening to watch one of them. CHIPS will be first, of course, since it's a musical, but it won't be tonight or tomorrow since I'll be weighed down with DAVE'S WORLD for at least two evenings.

Rubik's Cube - my boyfriend at the time figured out how to do it in less than 2 minutes and he taught me.  (I have since forgotten the formula)

There was a nasty manager at work (when I worked at UPS inthe 70's) who was very outspoken about the fact that he felt "girls" (like me) were being promoted to supervisors

I never thought of the Yoyo has a fad.  Children still play with them.  They still use Hula Hoops (we have one in the garage), just not like at the height of the fad.

The good news is I am DONE with radiation treatments and the Chemo is
DONE!!

Hopefully I will begin recovering from the side effects shortly.

The very, very good news that they believe they have successfully treated the cancer and I will be OK moving forward.  Of course we will be having
continuing checkups and tests but all the doctors are very optomistic

THIS IS WONDERFUL NEWS!! ;D

Rubik's Cube - my boyfriend at the time figured out how to do it in less than 2 minutes and he taught me.  (I have since forgotten the formula)

Danise is having her house totally redone. She is staying with Thelma while it is torn apart.

I can't say i totally loved last night's show. It was weird having no jack or kate. I miss sun and jin together. I hope they show him again (if he is still on the show). It's weird with so few people on the island. I am loving desmond and penny and little desmond. That was interesting to find out. I guess the surprise of the show was meeting young charles widmore. I have a conundrum and it requires me revealing the new Kritzerland release (replacing Lady Oscar) - I need opinions.

For those who have Laurette, you know I love incidental music from plays and our next release (not for publication) are two incidental scores from plays, including what is considered to be the most classic 20th century play.  That music is composed by a major film composer who also did the film version of the play.  The second score is by one of my personal favorite composers (composed one of the best scores of the 1960s) to a play based on a famous foreign story and then classic film.  Now, the music from the classic play had to be mastered from acetates, which is all that was available (at least that I could locate - who knows what might turn up some day, although I would doubt a tape source would ever turn up, unless it was just acetates put on tape).  The acetates, which appeared to be in okay shape, were just very very noisy, had a little groove distortion, etc.  The mastering guy did a really good job cleaning it up, but, after listening to it last night, it's still sounds a little dicey to me.  So the question becomes does history outweigh sound issues?  The intention was at make this a 15.98 release like Laurette and the first Herrmann, both of which came from acetate or vinyl sources. 

The problem with this one is that, unlike Laurette, there are only five or six instruments, so it's easier to hear the problems.  But the music is wonderful - the second score is in stereo and will sound fine.  And the CD will run over sixty minutes.  Please let me know what you think.

BK, if these are titles that you really want to release, then I say go for it!  You've established in liner notes from previous CDs that part of the reason you're releasing these is for historical purposes.  You've also specified that they weren't recorded under the most pristine conditions, so people who buy them won't expect that.  You've had great success with these releases, so I think people are more interested in just having the music rather than preferring that the audio quality of the recordings is absolutely perfect.

Tonight I bought a slim portable external DVD rewriter for my wind notebook.  It's and LG and I really like it. It's really light and will be perfect.  Most of my seminars now have the materials on CDs instead of books. Now I can stick the netbook and dvd drive in my purse and I'll be all set.

There were three counts.  The first, and most serious of the three, was domestic abuse against a man whose wife said he came home very drunk one night.  He started arguing that the food she made was bad and he began throwing things.  She tried to calm him, but she said he pushed her to the floor and then punched her on the face.  He then kicked her several times, she said.  She claimed she tried to call police but he had ripped the telephone line from the wall,  so she locked herself in her bathroom and used her cell phone.  Her husband was arrested that night.  He, too, had called the police.

The second count was for the man having violated a "stay away" order connected to the criminal case pending on the first charge.  She said she was in bed asleep one night last year and she awoked to find him standing over her.  He said he wanted to get some of his things.  She said she went into the bathroom, closed the door and called the police.  He left before they arrived, but he was later arrested.

The third count was strangely attached to the domestic abuse charge:  The defendant  is accused of being publicly intoxicated and committing battery upon the person of the owner of a restaurant/check cashing establishment in Oakland.  The charge stated he had cashed his check in the check-cashing section of the building and was loud, drunk  and raging.  The owner claimed the man was outraged they could not give him a receipt.  The owner said he offered to return the check in exchange for the money but that the man did not want his check back.  He said the defendant hit him and he fell.

I was steeling myself for some horror stories, but the end result was startlingly different.  I don't cotton to anyone hitting a woman.  Ever. 

In this case, with the cards stacked against him for abusing alcohol and being an ugly drunk, I (and my fellow jurors) could find no evidence to suggest that he ever did hit his wife (on the occasion for which the charge was brought) and no evidence was entered that  could contradict the defendant's claim that he was struck first by the owner of the restaurant/check cashing establishment.   The "stay away" violation was a no-brainer. He had been ordered to stay no less than 100 yards from his wife for three years...and that doesn't end until August 2010.

The prosecution's witness was a non-English-speaking woman about 5'4".  She was scrappy-looking and has obviously lived a hard life.  By "hard", I mean I think she's done a lot of heavy drinking.  She also is only a few inches shorter than her husband but looks to be solid and able to go rounds with him (and we were given evidence of MANY incidents in which either of the two were arrested individually for hitting or attacking the other).   To me, her biggest liability was a "false face"...she adapted a mournful look which dropped away from time to time when she actually veered away from her "account" of what happened that night.  This woman  changed her story several times. She said he pushed her and she fell on the floor  next to her son's bicycle.  The next time she told it,  she fell ON the bicycle.   She claimed he used his fist on her face and that he kicked her several times. 

His story was that he had come home from work and was sitting on his bed taking off his work shoes.  He said he could tell she was drunk and that she stood in front of him in silence for a moment or two.  She then punched him in the nose which, he said, bled profusely.  He stood up to leave the apartment but she blocked him.  He said he took her head in both hands (one hand on either side of her face) and then pushed her.  He was at the door and on the other side of the bedroom wall was his son's bed, beside which was his son's bicycle.  When he pushed her, he said he thought she hit the edge of his son's bed and then fell onto the bicycle on her right side.  He then left the apartment to calm down.  He returned a short while later to get his car keys and she was on the phone talking to the police. 

There are many moments of conflicted/conflicting testimony, but the discrepancies were what mattered. Photos that night showed her with blood smeared on the right side of her face (there were no left-side photos).  Most of the blood looked dried.  It was also smeared.   There was one wound above her right eye that looked like injury, but nothing more.   No photos of her stomach were taken.  Her clothing was clean and blood-free and no account had been given of her having changed.  One of the responding officers remarked that her son, who had been in bed, said that she had fallen onto the bicycle.

Photos of him showed redness under his nose...a blood trail and some dried blood.  While the woman had claimed her husband had ripped their house telephone from the wall, police noted the house phone was fully functional.  A shirt the man had been wearing was covered in blood.  There was also blood on the sheet of the bed.  When the officers arrived they found the woman on the bed and assumed it was her blood. The defendant said he never  saw her bleeding and that it was his blood which gushed from his nose. 

No photos were ever taken of the bloody sheets or shirts.  The wife said that when he hit her she was standing directly in front of him, face to face.  The injury above her right eye could not have been inflicted by a punch from his right hand.  She said he hit her with his right hand. 

Bottom line:  All 12 of us believed the couple had been in a co-dependent relationship that centered on alcohol and  personal abuse.  We were forced by law to acquit the defendant on all battery charges as he  claimed self-defense (which, in the presence of history of violence, says extra force -- and even pursuit -- is permissible if someone is afraid bodily injury may be inflicted upon him). 

In the incident at the restaurant/check-cashing establishment, not one witness was produced as to what happened.  We didn't even get to hear testimony from the cashier who had cashed the check and told him he could not have a receipt because their machine was broken.  When he asked her to write it out, she said she could not.  She sent  him to another woman and that woman is  the one who called the manager and the police.  She said he was drunk and angry and that their customers were upset.  She never saw who hit who as she was busy doing other things.   

Telling bits of testimony and evidence convinced us this man -- who has serious problems with drinking and anger no matter how you look at it -- was badly treated by the owner of the restaurant.  The owner admitted he tried to give the defendant his check back.  In examination,  however, he said he held out the check with one hand while trying to take the money with his other hand.  He said he had to forcibly pull the money out of the defendant's hand "and may have grazed his cheek" in the process.  That, by law, is BATTERY.  That,  by law, is the first punch.  And the defendant, angry and now enraged, decked the owner on the chin.  The owner fell to the floor.  The defendant then turned back to the cashier and asked if he could NOW have a receipt.  The owner got up and ran to his office.  He returned within less than a minute with a stun device.  He stunned the defendant, from behind, three separate times.  Someone then came from the kitchen and helped the owner eject the defendant from the building.  Photos clearly showed the marks from the stun device on the defendant's back and shoulder.  Photos taken a few days later showed severe bruises where he had been stunned.

The prosecution (district attorney's office representing the People of the State of California) had little to work with, unfortunately, in the way of evidence and witnesses.  He told us afterward that he had attempted to get the defendant's son, but that the son no longer  lives with either parent (the wife is actually the stepmother) and they could not get to him to serve him.  No witnesses were ever identified from the check-cashing establishment.  And SADLY, neither of the lead police officers at the two incidents was available to give testimony.  One officer who responded to the apartment incident gave testimony to a lot of details NOT in his police report.  The defense attorney got him to admit he had done a bad report.  He was fresh out of police academy where, he claimed, he had gotten good training for assessing domestic violence.  The defense attorney asked him if he thought his training for detecting domestic violence was as good and thorough as the training he received for writing reports!!! 

We heard "her" story, we heard the secondary police officer's story and we heard the defendant's story.  The one who came off as being the most credible was the defendant.  Even more credible than the police officer who said he saw no evidence that the defendant had been bleeding.  When showed the photos he denied seeing anything looking out of the ordinary under the defendant's nose. The rest of us saw the blood, as did the defense attorney.

Even though I thought the defendant more credible and, in the case of how he was handled by the police, badly treated both at his home and in the restaurant, I reckon he's a pretty ugly drunk with a tendency to throw stuff around and cause injury, either on purpose or by accident.

One thing that got my attention and perked me up considerably:  Both lawyers asked their clients (husband and wife) to recount "other" incidents they could recall (many of them a matter of police record, by the way, and not disputed by either attorney). The defendant said that he came home from work one afternoon and was  stunned to see his wife dressed in combat boots, camouflage pants and shirt, and wearing a beret and a black mask (like a ski mask).   He said he just stood there not knowing what to think or say when she lunged at him and started beating on him.  She knocked him down, he said, and then leaned over toward a piece of furniture from which she drew a machete!!!  He said he rolled her over and  stepped on the hand holding the machete and yelled at his son, who was watching, to run from the house.  He said he then took the machete and began to leave when he felt something pass his right ear.  She had thrown a hatchet at him and it lodged in the door.  When the police arrived and entered the apartment, he said she attacked one of the police officers.

That was never called into question as factual and both attorneys referenced it in their closing arguments.

I was AMAZED.

We had a good lunch yesterday as we were  treated to a nice meal at le Cheval, a fine French-Vietnamese restaurant a few blocks from the courthouse.  It's a popular spot for Oakland politicos/movers and shakers.  Today, we had sandwiches ordered for us (we chose what we wanted).  They arrived just as we were being dismissed following the reading of our verdicts.

I came home and went to bed.  I'm exhausted.

Today was really fun and my client walked out of the interview with an approval for her green card.  There were hugs and cheers, it was really a great day

Thanks, she's a 56 year old mother of 9 children!  Her husband (a legal permanent resident) initially filed for her years ago but then he cheated on her and they haven't been together in years.  They never were legally divorced so she was still able to get her green card, but no one had told her that before.  So, we filed it for her and today the husband flew back from California and he and 2 daughters went with us to the interview.  As he said, it was the least he could do for her.   When the interviewer asked why they weren't together he said it was about his infidelity.  That was all the interviewer really needed to hear.  From there on it was a piece of cake and she was approved in 10 minutes.

She is a very shy and humble woman.  She really never smiled much and always let her children talk for her.  That is until we walked out of the interview room she was glowing!  Her daughter let out a "Yes" so loud I could hear it across the parking lot, LOL.  It was a wonderful day

So... Another great day of auditions, final callbacks actually.  Good people, good songs, good will all around.  The "table" actually applauded after each audition, and the reaction was genuine and heartfelt.  I even received "exit applause" at the end of the day.  :)

The movie I just finished was, for me, horrible.  I think some people here loved it, and I know it was something of a critics' darling, but boy I did not laugh once in this purported comedy, and the reasons for it all had to do with its smart-ass attitude and lazy comedy writing - lines that I'm sure were hilarious to the writers but make the characters into complete caricatures, and once you do that, I'm done.  They want you to root ala School Of Rock, only School Of Rock gets it right and this movie, which tries to have all worlds (especially that of Christopher Guest) gets it all wrong.  Can anyone guess the film?

I believe we may have discussed this on the Old Old Board (if you catch my drift), but those of us who ordered the OCR of Golden Rainbow from Steve and Eydie's personal site were then privy to an absolutely hilarious barrage of emails from their manager to Don Ho's manager for a supposed co-starring gig in Hawaii.  It went on for some time before someone finally figured out it was being broadcast to the world.  Steve & Eydie didn't want second billing to Don Ho, let's just put it that way.  :)

I met up with some friends at 5 Napkin Burger for dinner.  Strangely enough, none of us at the table had a burger for dinner.  Well, I guess I did, but it was Pork/Chorizo burger with manchego cheese and a romesco hummus.  Quite tasty.

To start off, we shared a plate of their Deep-Fried Pickle and Pastrami Bites.  Another surprisingly tasty culinary concoction.  They roll slices of pastrami around bits of housemade bread & butter pickles, then coat them in a tempura-like batter for frying. They were served on a bed of sauerkraut with dabs of coarse mustard.  Yum!

While we were dining, we happened to run into Graham Rowat, Kate Baldwin, and another old fried of mine from DC, Jim Ferris.  Graham and Kate were in the San Fran run of White Christmas, and Graham is currently in tech for the Guys & Dolls revival.  They just happened to be dining there tonight too - along with a slew of other "Broadway Babies".  Good times.  :)

And my day finished with a recording session at Riverside Church.  My friend, Glenn, wanted to record three songs, three arias for an audition tape. Considering that I was basically sight-reading the three selections, and that my Classical chops haven't been used in a while, it all went quite smoothly.  Glenn listened to the playbacks.  I didn't.  I knew that if I did, I would start to here "everything", and since I was at the end of long day, that was the last thing I needed to do, to deal with. However, Glenn seemed happy with what he was hearing, and the engineer also had good things to say.

I'm happy to see that the film I watched tonight was a complete and utter box-office dud.  Of course, it was shown at Sundance and had a bidding war and the company that distributed the film paid an almost record sum for something at Sundance, almost as much as Little Miss Sunshine.  Oops.  They lost every cent of their investment, once one factors in prints and advertising.

We heard summations yesterday before lunch.  The Court assigned three deputies to walk us over to the restaurant and we were given a menu from which we could order whatever we wanted. The meal was courtesy of the Superior Court (i.e., the taxpayers}  We began deliberations at 1:30 p.m. yesterday.  We voted on the second and third counts yesterday and found we were all in agreement.

We then began discussing the complexities of the first count with its three sub-counts  (varying degrees of battery).  We all realized early on that if we believed the defendant acted in self-defense on any one count, we had to go with self-defense on all the counts.  We took a preliminary vote at the end of the day and found we were 11 for not guilty and one for guilty.  The holdout said she needed to hear the actual transcript of the defendant's explanation of what happened when he pushed his wife and she fell on the floor.    We were told we could have that this morning and we were done for the day at that point.  First thing this morning, the transcriber read all the accounts from the defendant.  We discussed it some more and began voting.  We were unanimous on each vote for each of the counts.
