Good morning, all! I slept poorly: first there were terrifying dreams about demons, possession, ghosts in the house on Goldman Avenue, and I believe my brother Macbeth and my mother were in that as well; then the neighbors arrived noisily home around 1:00am; then, around 2:15, a new mouse showed up, and I spent too much time tearing the apartment apart looking for the other glue traps I had purchased and I cannot remember where I put them! I got back to bed around 3:15, lay awake for a while holding a flashlight in case the mouse returned until I fell back to sleep, and then had more bad dreams about driving a truck around Middletown, Ohio!

I must take a fast trip to Toyland and pick up the ROBERTA full score going to the producer. I want to hand it to her on Tuesday when we mix DEAREST ENEMY, and I've got too much tomorrow to worry about besides carting home that score.

Once I'm home, I have nothing on my agenda but wait for whatever fresh hell arrives. I have no doubt it will be sooner than I'd like.

I finally watched Argo.  I enjoyed it very much but can't help be bothered by the inaccuracies, especially the line about the "Brits and the Kiwis" not helping, when in fact they did or were prepared to help.

Well there are crazy planet aspects this month, but they are quick - so problems flare and then recede -

DR ELMORE the end of April and the beginning of May is the second time of the year when the veil between the physical and spirit worlds is at its thinnest, so dreams and visitations are to be expected.

Have you thought about getting one of those things you plug into the wall that rids the place of pests?  We have several in the house and I have only seen two small mice in about 10 years.....

Speaking of psychic phenomena, it sounds as though the late John McGlinn may be leafing through his scores stored in the other room. I occasionally hear a page turn and it's sorta creeping me out. I've felt someone's presence on other days as well in the past year, but this morning, he's being particularly noisy.

Yikes.  It's been a while, but when I had people who will willing to pick me up there, I used to fly from (most likely) LaGuardia to Dayton to avoid the much higher cost of Cincinnati.

I haven't checked flights from Newark yet. During the Christmas holiday several years ago, US Air made all their flights connecting ones to Philadelphia and then went back to nonstop ones after Jan 2 or so, but right now, it looks as though most are one-stop flights and I hate waiting around an airport for two or three hours for a connecting flight.

 THE ENFORCER is one of my favorite 2nd tier Bogart films.

I recall my Dad taking me to it on my 10th birthday at the Orpheum Theater in Seattle.

Incidentally, the wrong girl who is murdered (she's on screen for just a few seconds) was played by Susan Cabot, a former publicity client who was actually murdered by her son.

That tragic event was the inspiration for my screenplay, MATRICIDE.

Yes, I saw them.  I think Juan hit it out of the park and I really think it will be First Degree.  Could I be wrong? Of course, you never know what a jury will do or what will happen when they deliberate, but I really think he proved the case

To celebrate Cinco de Mayo, we stopped for lunch at Taco Bell in Sidney, OH.  I had a Cantina Fresh chicken bowl (salad) which was quite good and not too far off my diet.

So far after only a few days I am loving my Marpac sound conditioner/white noise machine. This is the one I got (but I got mine at amazon.ca cause they have free shipping here and .com doesn't).

If you like a constant sound like a loud fan or air conditioner then you won't have any trouble sleeping to this machine.  It is a constand sound (not a loop recording like most other sound machines).

It blocks out a lot of outside sounds. DR Elmore I bet it work for your upstairs neighbor.  I can't believe I never knew these things existed.

Last day of the weekend reunion. We went to some attractive gardens south of London. Walked around for a few hours and had a leisurely lunch. The international visitors fly home tomorrow.

I cannot get over the warm weather for the past week. It is glorious. 80sh and sunny. Love it.  I went on my bike today. So that makes it six out of seven days this week. There is such a difference at the lake. There are now leaves on all the trees. At the beginning of the week they were completely bare.

Questions for DR Cillaliz:

1. Is it possible that if the jury deliberates a very short time that the verdict could be thrown out because they obviously didn't discuss all of the evidence long enough?

2. If she gets life in prison, would her case be appealed automatically, like it would if a death sentence is handed down?

So far after only a few days I am loving my Marpac sound conditioner/white noise machine.

That's great!  I don't think even this would cut the sound of the frogs in the pound-lol.  They really are fine except when we are watching tv or trying to talk.  Shutting the sliding door helps tremendously.

The penalty phase is afterwards DR LAURA - the jury decides on her sentence after another trial....and I think the DP is the only sentence that gets an automatic appeal, but then again, I am not a lawyer.

Today we went to Home Depot for Keith to get something for working in the garden to kneel on and take the pressure off of his back.  Oddly, considering the time of year, they didn't stock anything.  We then went to Lowe's who were out of stock of their items.

Next door to Lowe's was Office Depot where we found him a more comfortable office chair & new keyboards for both of us.  Mine is fine but they had the wavy kind I like & since Keith needed a new keyboard we got matching ones.  It makes it easier when our keyboards are the same.  We will keep mine as a back up.

I always enjoyed overcast and cool days in L.A.  And I really loved the "winter" season.  Part of this was conditioning, from a couple of my places having poor or non-existent a/c.  But beyond overcast and cool, I really loved those rare days when you'd have real clouds overhead, giving more "dimension" to the lay of the land, the buildings, etc.  That happens anywhere, of course, but in L.A. you can get rather starved for it, and become much more attuned to it.

I should have shut the sliding doors in our bedroom sooner as it has gotten rather chilly out.  I had to change out the flannel sheets today so Keith could slide more easily with his sore back.  Guess I will be wearing flannel p.j.'s to compensate.

During the night I was having a slew of unpleasant dreams, then suddenly I was in a car and two birds came flying right at us and one hit the window.  I gasped rather loudly & woke Keith up. 

Once back to sleep the various  dreams continued & I woke up rather tired-lol.

Three hours of telephone calls this evening. Good to catch up, but I feel three hours behind on everything else.

our Latino members hosted our coffee hour today - we had tortillas and homemade salsa and jalepeno cheese, dulce de leche cake, and some homemade "donut holes" or "munchins" that were a Peruvian pastry

Holy Moly on Rye!!! I've heard some strange noises outside tonight and since I've been reading Amanda Knox's book and watching the Jody Arias trial I was a bit spooked. I thought it wasn't anything...then Ricky started going crazy at my bedroom window upstairs. I was telling him it was nothing when I looked out and a pair of eyes was looking back. I screamed, went to the bathroom for a better view and there was a raccoon looking in at me.

I was banging on the window to scare it, but it wasn't going away. I have to say I breathed a huge sigh of relief knowing that was the cause of the things that were going bump in the night. I think it's living under my gazebo.   I'm going to try to find a service to trap and move it.  And to check my attic to see if he got in.  They can do so much damage that I don't want it living here

Questions for DR Cillaliz:

1. Is it possible that if the jury deliberates a very short time that the verdict could be thrown out because they obviously didn't discuss all of the evidence long enough?

The defense could argue it on appeal but it wouldn't work.  Once they are in the jury room it's pretty much up to them.  They've been listening and seeing the evidence since January 4.  If they have all been convinced beyond a reasonable doubt, they've all been convinced beyond a reasonable doubt.  You would have to prove some sort of misconduct - acutally violating the rules or undue pressure on a juror or something like that before it would make a difference

It probably isn't automatic, it may be, but it will be appealed if the verdict is anything but not guilty....you can mark my words on that, lol

The penalty phase is afterwards DR LAURA - the jury decides on her sentence after another trial....and I think the DP is the only sentence that gets an automatic appeal, but then again, I am not a lawyer.

Yes the penalty phase is afterward, but you can appeal a conviction, a sentence or both

Yup, another trial with the same jury.  That's why the alternates have to sit in a room in the courthouse.  They could be called in if a juror is excused during deliberations, but they are also included in  the penalty phase trial

The second trial is all aggravation and mitigation.  Some information not allowed in the first trial may be admissible in the second.

I don't know that a verdict gets thrown out very often, unless it's clearly contrary to the evidence, and if that's the case the judge should have granted the directed verdict.   If a case is reversed it's usually based on a legal error somewhere in the trial.  I guess you could call that throwing out a verdict, but it really isn't.  It results in a retrial though.

I do have to say she's quite a fascinating character.  I really want to see her expression when the verdict is announced.  It's a win fo her if it's second degree or manslaughter.  I still think it's going to be first degree, though

So, if this case has gone on since the first of January, it has been about 18weeks. Four days per week at $12 per day. Each juror has been paid $864.

And I think it should be first degree.  My dad watched a lot of the closing arguments.  He hasn't watched most of it, but he said just looking at her he thinks she's one tough cookie.   I think her general demeanor goes completely against her claim of being a battered woman.  I don't believe Travis ever hit her unless it was some consensual sex game or he just got so sick of her stalking him, sneaking in his doggie door, slashing his tires etc.   I have to say he was pretty stupid to let her in that last time, but I'm not totally convinced he was even expecting her.  She knew how to get in without being invited
