Well, I'm plum tuckered out from all that driving (to Seattle and back), so I'm going to turn in...into what?  I don't know.  But it involves a cocoon-like state with little or no movement (or even thought ;)) for several hours.  Good night, all!

All these new avatars. I won't be able to recognize anyone.

Nothing in any of the slots this morning. I do plan to join our birthday boy (and others I assume) this evening. Anthony may join as well depending on the progress of his foot. It's not in bad shape but it will take a while to fully heal. The podiatrist and many others have said that. In fact, two people in Michigan at our family reunion/welcome back to my brother had the same problem. One had surgery and the other deals with it from day to day.

Off to wash my oatmeal bowl and then on to work.

How am I spending my birthday, so far?

Well last night on the way to rehearsal, my car started making a terrible noise, so I turned around and came home.  And in a few minutes, it will be on its way to the garage - hopefully to be repaired.  Goodbye, $$$$!

I got my ADAM-12 DVD set yesterday.

ALSO I took the advice of the DR's here on HHW and bought a new surround sound system.  Befitting my enemployed status, it is a DuraBrand model from WalMart, but is doing as well as my Emerson HT-200 did....and it was about $80.  So it will be fine until employment comes along.  At least I have ALL five speakers AND a subwoofer!

As to the Mario Bravo book that BK mentioned. I know which magazine he talks of. I never took him up on his offer. 1) Because it was too much money 2) The book hadn't been  done yet. 3) I didn't want to take a chance of a book that wasn;t a book.

Over the years I kept on seeing the full page ad for it. I felt that I was right in npt taking a chance. In the lastest edition of the magazine they announced an actually date. I said I'd believe when I see it in the stores.

On long the way the magazine went to full color. I guess have that cushion of 100,000k has helped.

I think there should be a class action suit against the author to get the money back plus interest depending on how long it has been since you placed the reorder.

Since BK hasn't mentioned the name of the magazine (which isn't bad for some of its in depth articles) I won't either

Who is soliciting this book?  If it is someplace like Amazon or CD Unverse the credit card won't be charged until the item is shipped.  If it is Paypal, then beware... they charge the card as soon as the order is received.  This is one reason I hate Paypal and the only time I will use it is to buy something from BK since I know he won't $%@# me around with false promises of shipping dates.

I communicated with the Greek last night via Instant Message. I wish I hadn't. Greeks can be so damned charming...it's really frustrating. And then Greeks can turn around and tell you that they randomly made out with someone at a bar the other night because they were Greco-drunk. Why would a Greek tell you that? To make you jealous? To make you think they're Greco-trashy? I don't need to be told these things!

Greeks are stupid. And yet I love them. Damn my ever-lovin' Anglo heart!

It looks like Ape and Maggot have approached J & H (janelle/howie) to backdoor james.  They want them NOT to pick james for the veto.  They seem like they are genunie (april and maggie). However I wonder what they (J&H) will do.  They were sort of working with james. But if they get james to play veto, and he wins and takes janelle off, then they would probably vote howie out. So we shall see. But it is not over for J&H.

Der Brucer is off to spend the day with the grandlads.  It's open house at their school, and he's taking the opportunity to meet with their teachers.  I think he's trying to establish with the teachers that there is someone sane in the family, and not to judge the lads by their parents.

Meanwhile, I don't start work today until after three, and won't be getting off until close to midnight.  (That's close to nine at night, for you left-coasters.)  After which, der B will want me to fix him dinner!  Yipes!

Re: the never-ending book.  That sounds totally crazy!  I guess the lesson is to never pre-order unless it is from someone we know (like BK) or something reliable that you can cancel (like amazon).

bk, this is the kind of thing that drives librarians crazy!  We order something, put it in our catalog, start building a reserve (waiting) list, the title changes, changes again, and again, and when we can't supply the book to our patrons they get mad at us.

As for the specific case, I'd contact the attorney general in the state from which the individual does business.  Or I'd ask for interest on my "investment."

Now, as to this BOOK DEBACLE, I recall BK talking about this during his last visit here, and I can't believe it is still going on.

The reaction is, "Ain't there laws to stop this kind of thing?" It seems to me most ads for products give people a window of time: "Items deliver in 6-8 weeks," that sort of thing. That window of time may be a requirement. How this works with pre-orders I do not know.

But if people are speculating on the internet that this may be his downfall, they need only amass in number and contact the State ATTORNEY GENERAL of whatever state out of which he is doing business. It would only take a few calls to get them interested. Once you call, they usually ask you to put your claim in writing. It would be nice if someone has printed out the various songs and dances this guy has spun over the last few years. Including the longwinded emails while he was supposedly slaving away.

The sad part is, what people really want is the book. Whether this was a planned scheme or the guy just got in over his head, I don't know. But what he is doing is wrong. Someone needs only marshall the forces of those who've been burned, and at the very least, have a lawyer draft a letter from concerned parties.

In my CD player at work:  Sergei Rachmaninov's Symphony No. 2 in E minor, Op. 27, Vladimir Ashkenazy conducting the Concertgebouw Orchestra, per BK's recommendation.  It is quite beautiful.  And BK is absolutely right about the third movement (the Adagio).

In my VCR:  tapes of shows from the last couple of nights that I haven't had time to watch, yet.

In my DVD player:  "Bells Are Ringing" and a couple of other new things that I can't remember off the top of my head.

Yes, I can ask for my money back, and yes, from what I understand from others who have done that, is that it will be forthcoming.  But, as Ginny mentions, shouldn't there be interest on the money?  Certainly, HE'S been continuing to earn interest.  Some people think he's spent the money and simply cannot afford to print the book.  I have no idea if that's true or not, but certainly the speculation has been made.  The other option, of course, is to contact the Attorney General of his State.

The problem of course is that the people who sent the money REALLY want the book - but they bought something that doesn't exist.

Yes, the AG of his home state should be contacted.  Ask for the Fraud Division.  They will send you a form....or most likely this can be done at the website for the State.  I know Indiana has an online form.  

Well worth looking into.  This is a fraud, plain a simple.  Not even a bait and switch.  And hopefully someone has copies of the ads.  The progression should make the swindle clear to the authorities.

My CD player still has the same CD's that have been in there for the past two weeks.  Been listening to CHAKA KHAN and CELINE DION a lot on my ipod, though.

As to the case of the never-ending book, I haven't practice as a lawyer in years, and I don't know what state the culprit is in, but based on what I learned in law school over two decades ago, in most states, there needs to be damage for someone to sue.  Meanwhile, it sounds like everybody who's asking for their $97 to be returned is getting it back, so who can claim damge, except for mental discomfort?  As to the interest on the $97, the interest rates have been so low that even for people who paid their $97 five years ago, we're talking damage of less than $10 per person.  Has anyone actually asked for interest on their money and been refused?  (The foregoing, I must hasten to note, is not legal advice, just an analysis based on what I remember from years ago.  :)  )

Bruce if you ask for your money back and get it, that’s it.  Frustrating yes but not worth pursuing any farther.  Even if you could take legal action, which I expect would cost more than the interest lost, at the time you ordered you were aware of the history of this book so I doubt you would have much of a case.

It does make for an interesting column so you got something out of it. :)

I wasn't clear until just now that the author of the Bava book personally solicited money for the book. I kept thinking as I was reading the story that Amazon doesn't charge a credit card until after it ships an item, and since the item hadn't shipped, no harm, no foul.

But now that I know the funds went directly to the author, I think it stinks and stinks to high heaven. I'd request an immediate reimbursement.

I've watched the first five episodes on the WILL & GRACE Season 4 set. The show was still consistently funny (though this is the season that ends in the catastrophic baby-planning storyline and making way for Grace's disastrous marriage the following season), and I've quite enjoyed the shows thus far. Nice to see them looking so good. I can now toss the homemade videotapes I made.

I'm looking forward on the W&G set to the episode entitled "Jingle Balls." It featured the terrific Larry Sullivan as a ballet dancer involved with Will. The episode is hilarious, but I've always felt he was the boy friend that got away for Will. The producers had a very cute, very charming actor here who would have meshed really well with Eric McCormack, and they ended the relationship after a single episode. A very foolish decision.

DR Matt: I've always wished that Will would have stuck with that ballet dancer - I just never knew the actor's name til now! He was so cute and sweet...perfect boyfriend material, it would seem, unless you're bothered by having a dancer as a boyfriend, which I don't think I would be.

And I definitely feel that "W&G" 'jumped the shark,' so to speak, when they went with the whole "have a baby" plot. That's a plethora of quotation marks to deal with, so I'll leave you with that.

I don't like that expression "jump the shark" but in the case of W&G, I do think that was the beginning of the end of the glory years of the show. The staff writers were equally divided about going through with it, and I think this split in their opinions led to much unhappiness at W&G (also the creators started their feud with NBC over money around this time.)

I don't know why the Disney big shots do that. I wonder what they'd think if such system were used for their films in other countries: of course, they'll never face that situation, since they control everything!

If the original version has moments without music... it's meant to be that way. It's not gratuitous. Do they think the American audience would not "get" that and needs wall-to-wall NEW music?? How arrogant! :(

The DP and a very DF of mine are heading to the Cruz of Santa and the Beach Boardwalk tonight to catch the 80's band "Survivor" in a concert on the beach.  I love the Boardwalk as does my DF, however the DP isn't excited as "they have better boardwalks on the east coast and Californians don't know what a real boardwalk is!"  So, the DF and I are determined to show him a good time.

Well I survived the blowing of Katrina.

I think people made it bigger than it was supposed to be. Just a lot of rain and wind.

We've barely even gotten any showers from it.

I had my mid term eval today.  It went fine like always.  I'm always very nervous before one.  I don't know why.  I never get a bad review but it's like getting a report card.

I think the Never Ending Book story is a horrable tale.  I would do my best to get my money back with interest for your time and disapointment in not getting what you were promised, BK.

I also have a BK question.  I don't know what put it in my mind but on the bus ride home I was thinking, What will happen to the Haines His Way board?  I mean down the road.  Will it be saved to a disk/cd some place?  Will a book be made about the posts?

We spend so much time here and share so much of our lives that it's like a diary of sorts.  We've been here for each other when things were good and when things were bad.  

Someday, when we're old and gray it might be nice to look back at our posts and reread what was going on in our lives at the time.  Is that possible?

Weird thought, huh?

I was very productive today and pulled out tons of stuff from our cabinets.  Then I got tired and left half the stuff sitting at.  Needless to say Keith is frustrated.  I took a very short, 5 minute, nap and have eaten.  I think my energy is returning so I can finish what I started.

I can however archive the early posts beginning on November 9. 2001.  I found some interesting people, Elan for one. :)  Also amongst the first posters was William E. Lurie.  I sure miss him.  I continued to read through to the 5th day when I made my appearance.

I ordered a pizza from Pizza Hut at 7:30. They told me it'd be 40 minutes, which we could live with. At 8:40, the guy calls and says he's on his way. At 9:05 the pizza was still not here, so I called to complain and the girl on the phone said, "the driver's out for delivery now." I said, "he's BEEN out on delivery for 35 minutes - I don't want a cold pizza!" She said it was on its way and I said I wanted to cancel the order. She hung up on me.

So I called back a few minutes later 'cause I was pissed off and asked to speak to the manager, who sounded like he was a 14-year old from the South Bronx. I explained what happened and all he offered was to have the guy go ahead and deliver the order and only charge me HALF - OR I could give him my address, which they'd "put on the wall" and next time I called I could get my order for half off.

What's this "half off" crap? After an hour and a half the pizza still hadn't arrived and he wants me to PAY for the damn thing? I don't think so! It's a $15 pizza - give it to me free. ESPECIALLY if it's gonna be cold when it gets here!

I told them that I would prefer NOT to put my name and address "up on their wall" and that I was uncertain as to whether I would continue business with their establishment at all.

Now it's 9:20 and no one has eaten. I'm thawing a pound of ground beef at nearly 9:30, which means no one eats for at least another hour.

Half price my ass...

Our, it was really for Keith, beautiful flower arrangement lasted a full two weeks and I still have a small bouquet of yellow daisies.  Two of the deep red roses dried out and I have them in a white bud vase sitting on our new powder room sink.  Keith agrees they look lovely.

Just got back from JoseSFestival. And who was there? Elmore, myself, Ben. The Punk made a cameo before she had to go off and see a show. Then the minds behind Jose's recent Willamstown show came. And some other fellow who met his wife due to Jose. Mexican food was demolished. Margaritas were polished. (Not by me though, I took the night off of alcohol). Laffs abounded. Laughs too. Jose will most likely be out all hours, especially if things head towards the Cabaret circuit.

The Neverending Book:
A little net research indicates that one needs only be guilty of misrepresentation to be guilty of fraud. If he collected monies via US mail, there is a case for mail fraud. The misrepresentation is clear enough. Especially if he established definite printing dates. That's just my take on things.
True the interest is not that great per person, but it is the principle of the thing (no pun intended).

My handy-dandy legal dictionary says that fraud is "intentional deception resulting in injury to another."  One of the elements is "rightful or justified reliance." Another is "the person's ignorance of the falsity of the representation."  Again, this is not legal advice, but I don't see what injury has occurred if the guy's willing to refund the money to anyone who asks, and as Jane's post suggested, anyone who bought several years into the process probably can't claim to have "rightfully or justifiably relied."

We settled on MULHOLLAND DR. The DVD has been sitting here for a couple of years, and I must say, it was provocative and something I couldn't take my eyes off of for fear of missing the key to the film. Actually, I don't think there is an exact key, but I know my own interpretation of it. Certainly it's a film that if you made it all the way through, you should want to watch again just to see all the pieces of it again.

I'm not sure I'll put it on again in the next month, but I think a few months down the line, I'd like to experience it again with some foreknowledge and a more critical eye towatd Lynch's effects and motifs.

Interesting point FJL. I certainly defer to your legal expertise. Though there does seem room for complaint when one goes by the USPS definition of mail fraud:

MAIL FRAUD - 18 U.S.C. 1341, makes it a Federal crime or offense for anyone to use the United States mails in carrying out a scheme to defraud.

"A person can be found guilty of that offense only if all of the following facts are proved: First: That the person knowingly and willfully devised a scheme to defraud, OR FOR OBTAINING MONEY OR PROPERTY BY MEANS OF FALSE PRETENSES, REPRESENTATIONS OR PROMISES; and Second: That the person used the United States Postal Service by mailing, or by causing to be mailed, some matter or thing for the purpose of executing the scheme to defraud."

The misrepresntations and promises seem clear enough. The "knowingly and willfully" would be harder to prove, of course, as the guy would just argue that things kept going wrong out of his control. However five years without a book seems somewhat willfull.

The ideal would be to find everyone who ordered and get them to simultaneously ask for their money back, then see what happens.

Back from a lovely dinner with Mr. Terry Trotter and his fiance, Erica.  More about that in the notes.

Danise: This site is like no other on all the Internet (though, heaven knows, some have tried to usurp its elements) - I have no intention for it to go anywhere, but yes, if something was to happen, I would have its entire contents saved to discs.

I've been home (and signed in) but I've been watching Dateline NBC.  They had a two-hour episode (I don't know if this is normal or not) about a man who deserted the army in the late 1960s.  His family (wife, two kids and mother) here in America thought that he was dead, but he wasn't.  He was in Australia on vacation and just left.  He eventually moved to New Zealand and had a whole new life.  It was very interesting and quite emotional.  

Everything worked out, though.  He was even able to get a discarge under honorable conditions because he had signed up for two tours of duty and asked for a third but the army said to go home.  It was then that he left, so he didn't leave the fighting.  The story was originally broadcast 10 or so years ago and they had an update from last year and from this year.

And now, Battlestar Galactica is on!  I like this show...no matter what anyone says. ;)

I have been very busy today getting things ready for my yard sale tomorrow. Mark and James will be down from Wilsonville at 7am with a truck load of stuff to get rid off and Terry will be bringing his items down from Vancouver.

I myself hope to be rid of all the junk that has been accumulating in my garage the last couple of years...furniture, clothes, odds and ends...mostly odds!

We will only run it from 8 am to 1pm...then each some lunch and enjoy the rest of the weekend! With extra pocket change, I hope!

VHS: Nothing...in fact I am getting rid of a whole lot of them at the garage sale!!

CD: Dug out my various Ultra Lounge CDs and have been listening to them in the car this week.

Good Evening!

Final count: seven margaritas, one rum and coke, and three regular cokes.

And best of all, my hands stayed to myself the whole evening!

It truly was a great birthday.  Very casual as I had "planned", and I got to see and catch up with a bunch of people.  *And I also had a ton of e-mail greetings waiting for me when I got home a few minutes ago.  A very nice birthday indeed.

And now to read the posts from today...  Probably see you "tomorrow".
