Here is my question I know that the experts on HHW will know the answer.

Since the new members have to be sworn in by the Speaker of the House - and there is NO Speaker of the House.....why are they voting? Or is there a rule of law that permits them to do so at the opening of the Congress?

Perhaps the swearing in is just ceremonial.
