Ha! Kerry got my jury summons!!

Next time if you get one around Thanksgiving, ask for a continuance for the week between Christmas and New Years. They won't schedule trials then.

Thanks.  So far I'm not worse & I'm managing to focus on a book which helps.  It wasn't fun not being able to do anything.

Good morning, all! I'm working at home this morning, then meeting my friend Paul Ford for lunch at the Westway on 9th and 44th. I've got three numbers to finish for Act One of Gentlemen Be Seated! and I'd like to finish one of them before I head out.

DRs Cillaliz and JRand64, I appreciate your thought on the Mekeel situation. I do realize that he needed serious help and the friendship we had thirty years ago was a completely different one than it would be now.

DR Elmore, he clearly valued your friendship as he entrusted you with the poems he wrote in his journal.  If you want to visit him, I'd suggest writing to him first.   Sometimes you have to put people on your visitation list or they can't visit. Having had lots of contact with people in prison, I can tell you that contact from people they knew and cared about really means a lot to them, but you don't know his frame of mind, so initial contact in a letter is a good idea.  If you need help locating him, pm me, I'm sure I can figure out how to locate him

DR CILLA LIZ - the defense team for Jodi A. has been outrageous in its behavior during the mitigation phase of the sentencing trial.  They are basically retrying the case in front of the new jury.  Shouldn't the judge stop their antics?  If it doesn't go to mitigation, should it be allowed.

Their witnesses are defiant of the judge and the prosecutor.  Now they are asking for a mistrial because they say they have 13 witnesses who are too afraid to testify.  Arias herself gave SECRET testimony for a day and half - no press no public no cameras - the Arizona Supreme Court finally ruled on Friday that that was not legal and that those transcripts must be released.  No word on whether she will continue to testify, but if she doesn't, that testimony will be stricken, I assume. 

Defense team has also charged prosecutor misconduct saying that they erased evidence from the victim's computer while it was in the property room of the local police department.....they have a couple of wacky computer scientists who are trying to prove that.  They want all charges dropped - even though she has been convicted on murder one with premeditation and heinous actions.

It's a mess....and her defense has cost DR LAURA more the $2.5 million dollars so far.

2.5 million, I should have stayed in Arizona, lol.  Yes, it does sound like they are being outrageous. But, this jury hasn't heard the testimony from the trial and the facts of the case are usually considered as either mitigation or aggravation.  So, at least some of that should be allowed.  They made allegations about things being erased from the beginning.  I don't know how far that will go.   

One thing you should understand is that you have to object to everything and try to get evidence in about everything you find objectionable for appeal.  If you don't object to something, you waive the issue on appeal.   Also, for issues like the erasing of the computer, if you don't make an offer of proof or try to get the testimony in whether in front of the jury or outside the juries presence, it won't be in the record on appeal and the appeal court won't have what they need to review the case.

I loved J.K. in the musical BIRDS OF PARADISE.  I had seen him in 1990 as Jigger in a Houston Grand Opera production of CAROUSEL was was clse to definitive.  The 1966 Lincoln Center production with John Raitt, Jerry Orbach, Susan atson, Ried Shelton was definitive.

elmore, who is your friend, Paul Ford?  Is this the New York, writer, Paul Ford, or is there another Mr. Ford with whom I should be familiar?





I've known Paul since he played piano for a concert production of ONE TOUCH OF VENUS at Town Hall around 1983.  He was the roommate of Bill Tynes, who produced the New Amsterdam Theatre Co.  He played piano for rehearsals and show for every Sondheim musical after SWEENEY TODD, I believe, and he worked with Paul Gemignani for years on concerts and other shows.  When I worked at Drama Book Shop in the 1980s, I used to see him coming to play INTO THE WOODS or SUNDAY IN THE PARK or PASSION as I was heading home.  He's a dear friend and as crazy as they come.  Kinda like you, DR TCB!

I was ging to call the Essex County prosecutor's office tomorrow afternoon and see what I can learn about where he is, his attorney, etc.  I thought I would contact the attorney representing him first of all. I'm not keen on just jumping onto a train and making a random search of New Jersey prisons

In some states they have to reimburse but at the $20 a week or whatever it is you make in prison, it isn't likely that will happen, and I don't think AZ requires reimbursement.   If we didn't have the death penalty, it would be a lot cheaper.  Fewer appeals, fewer reversals, fewer retrials.

I am home from a loverly brunch with Mr Paul Ford, who is always good for a laugh and a nice visit.  He is preparing another concert tour with Mandy Patinkin, staged by Susan Stroman.


It looks like this is the show - "The Last two People on Earth" which will be at American Repertory Theater in May

what I want to know is : How are jurors supposed to pay their mortgages and their other bills?  How are they supposed to keep their jobs?  I understand the reason for a jury system and being judged "by a jury of your peers"  but  (at least  here in NY)  the daily pay is maybe 20% of a normal daily salary   AND  you don't  get any of it until about four weeks after the jury duty is completed... if you are living paycheck to paycheck  what happens?

There is a notion DR VIXMOM that the Defense Team, among other shady actions, is prolonging things in order that they will lose enough jurors to cause a mistrial.

That's a possibility

The defense attorneys are doing their jobs: get the least penalty possible. I can't blame them for that.

I just think that the prosecution should have asked for life in prison, then we wouldn't still be going on with all this.

The library where I work used to have a policy that if we got paid for jury duty, we had to "donate" it back to the library.  I don't know why that started, but several years ago, that was changed.  I don't know how much it is, but it's really a tiny amount compared to what most people make in their jobs.

He's great on that recording, too. He was also in the revival of "Guys and Dolls" with Nathan Lane as one of the guys who sings "Fugue for Tinhorns."

I think that's about what it is here, only without the mileage.

Where I work, they just let you keep it because you're doing your duty. But at the newspaper, you had to turn in the pittance check.
