DR FJL, this constant bashing of City Center and Jack Viertel here and elsewhere over events that happened over five years ago is not good.  It's certainly obsessive, but I am afraid you are only hurting yourself and I hate to see this.

Thanks.  I hear what you're saying.  And I appreciate the sincerity of your feelings about Jack. 

Five years is still within any NY statute of limitations, but most relevant, the 54 Below owners took a shocking, severeaction this year based  on Jack Viertel's opinion 5 years ago, an opinion which he held on to.

And regarding that festival with the 25 shows, my show (with great co-workers and cast) got nominations for best production, the book/lyrics, best actress in the festival, even a unique category they did for best publicity work!
And my leading lady won for best actress.  But they had to face, and I understood their plight in this case,  they could not afford to choose me or any of my work again since but would mean no chatter for the festival in ATC, which was a key audience low-budget ad source for them.

This was their February/March festival.  Their summer festival that same year, and their cabaret festival, of course, did get full ATC coverage.  Message clearly sent!

Larry, since you said this today, just to recap:  (sometimes the smoking gun is not evident while the emotions of what he was doing are going on.  He was getting angry and sarcastic over something that it made no logical sense that he was getting angry about.  Why did Encores, or City Center, or the City Center law firm care so much about Talkin Broadway, for heaven's sake, that such an exchange would even happen?  I didn't know then, but  it's looking more clear now.  Maybe call it "Smoking Gun's Café")

Not a clue in this rich, straight, non-disabled, very powerful, Caucasian man (who’s made a career of works like Hairspray, Dear Evan Hansen, Angels in America, the August Wilson plays, produced the Broadway Finian's Rainbow revival revival) that the idea of protesting discrimination and Human Rights abuse is:
-That they were not letting me in, and I wanted to be allowed in
.  To all they offer anyone else in the public, any artists.  Their networking events.  Their discussions. 
- That they were not allowing coverage or press  of my work, and I wanted them to allow coverage of my work. 
- That when I was in a festival with 25 shows (MITF), & they embargoed any press releases that included my work, they left out the whole festival of 25 shows just that period, letting the festival know about choosing my work again.

Then hire a lawyer, take action, and see how it lands. Either finish it or let go of it.  I fear that this constant barrage is only making you more of a bête noir that no one will want to work with and I don't like that.  I worry that these constant attacks that have gone on for at least three weeks here and on other boards, along with a flurry of emails to City Center and others, will hurt you more than anyone else. 

Several years ago, at an Encores! production, I ran into Ted Chapin in the lobby, and he made a reference to something I had posted on HHW that very morning. You never know who the guests are reading these posts. Be careful.

Right, and why was City Center's lawyer Neil Rosini so insanely worked up about Talkin Broadway winning the January 2013 government complaint? 

What's the connection?   It made no logical sense at all in 2013.  It's pretty clear now, after the facts about 2017-2018 (not conjecture at this point, since an August 12 email from 54 Below) that came out from the matter with 54 Below. 

(And yes, with hopes always being that all can resolve amicably, dawdling can happen in looking at things - but there's a rather hard statute of limitations coming to May 16 2019.   I can't have a lawyer handle this, as it's getting very clear that it's only when the NY State government handles it, that the rules against retaliation for the Human Rights complaint ever really matter at all to. City Center from a practical matter.  If I file a lawsuit, they will retaliate away!!! It's shocking behavior for a Nonprofit.) 


The truth is they have been retaliating (just letting their lawyer do the oppressive deeds) even with Human Rights matters when it is illegal (meaning civilly illegal, not criminal) to retaliate.  How much worse could City Center get with a real lawsuit, when issues can get beyond Human Rights, and then it's not so clearly unlawful.

DataLounge really got caught, and forced Dec 2013/Feb 2014 to expunge all the bizarre stuff that was coming up in searches for me on google, because of the retaliation they did; then the State followed on that retaliation.  It sounded at the Feb 2014 hearing in the Bronx like the in-house attorney who appeared from DataLounge/Mediapolis didn't know what they did was against NYS law until NYS Human Rights agency investigated.   

(It seems from what they were arguing about Federal law that it may not have been against Federal law.)

This was an area I did relatively poorly in Prof. Bartholet's class in law school. 

But it sounds from what was argued like in the Federal law, (compared to NYS) a site back then (2011-2013) must have had  much less responsibility for fixing about  complaints from people who are talked about, not wanting to be talked about on a publicly available site.    (the Twitter battle over the Mike Tyson on Broadway threats, for example)

Letting go of anger is a good thing, as in the end it either destroys or serves no purpose.  I certainly was in that situation with what happened in 2001 and the resulting lawsuit that basically wiped me out.  Was I angry?  You bet.  Did I want to scream and yell about it every day?  You bet.  Did I?  Nope.  If you go back and read the first year of posts here you'll see that I dealt with it with humor and believe me they and their lawyers were here every day reading every notes and every post in what was then the comments section.  I gave them NOTHING, no anger, and it drove them CRAZY.  When they deposed me they did every single thing they could to get me to erupt, to blow my top (they were videoing me) - I would not do it, I was calm, funny, charming and within five minutes of me finishing two things happened: My attorney said he'd never seen anyone handle themselves better and they asked to mediate and end everything, which happened literally a day or two later.

Recovering from that was very hard.  But I never let anger rule me.  If you read Album Produced By you will see that clearly.  I got all my negative stuff out of me writing Rewind.  It was freeing and wonderful.

They made sure I can't have a lawyer handle this, as City Center's been using our own law firm (different lawyer, of course) in matters against me, and their lawyer in the firm (Neil) chose to ignore my objections that one of his partners (Elliot) has been our only lawyer since the 1990s, and had then (it was Feb. 2013) advised us as recently as a 2010/2011 project.  The City Center lawyer Neil insisted I had no dealing with our lawyer since the 1990s.  I showed Neil a 19-page fax to Elliot in 2011 with my detailed handwritten cover page, and that I was still in the  Client Newsletter list - and yet Neil marched on.   

(What recourse do you have against a huge law firm? They have you - if you claim an ethics matter against them, they say, well now you have a grievance  against our firm, we can't represent  you because of that.)
