I once served on a competency hearing panel. It was strange because it was the exact opposite of a jury. The defendant was competent unless proven otherwise. The tiny old man's attorney tried to make it seem as if his client was incompetent because he spoke Spanish, not English, and because he was alcoholic. Since half of the panel was Hispanic, several found his argument ugly, to say the least. We found him competent.
We could not know what the man was charged with, but I checked at the newspaper when I got back to work: He was charged with beating one of his sons to death while he was in an alcoholic stupor. The rest of his family had been at the hearing, but not a one seemed to be there to support him.
