You know, my biggest fear about tomorrow morning was that I wouldn't find a taxi at 5:30AM, and the worst part of today was that I had already been through one round of the Surprep and was just about to begin the second.

I was so relieved that I could eat breakfast that I had a fried egg sandwich and a glass of apple juice.  I may spend the rest of the day napping with Thatch and Stella.

There is a man on TV talking about things to do while at home and each and every thing he mentioned was about the internet and apps.....no mention of reading a book, listening to music, or talking to someone else in the house.

At 9:50 this morning, Dr Glickman, the urologist who was going to remove the tumor from my kidney, phoned to say that he and Dr Aronoff had decided to postpone the surgery for 4 weeks or so.

I wish he'd called before the first round of Surprep!

I am sorry you started the prep.  Rest well the rest of the day.

I'd gotten this from Rick Pappas, who is the lawyer for Stephen Sondheim.

From: Rick Pappas <pappasesq@earthlink.net>
To: Fred Landau <fjl1960@aol.com>

Dear Mr. Landau,
Apologies for not having responded to your emails sooner than today.
I did not have anything to do with any ‘copyright claim slapped on’ to your posts. Those would have come directly from the music publishers, who routinely police infringements of Mr. Sondheim’s works online.
I am unaware of any pre-approvals given to earlier videos by Sean Flahaven (who hasn’t worked at WarnerChappell for over two years) or Arminda Trevino (who also left two years ago) at Carlin America (which no longer exists). I can only say that none were ever presented to me by either company during the past 11 years that I have been involved in Mr. Sondheim’s matters, and they would have been submitted for authorization by both publishers in the ordinary course of events.

(and it goes on). but he is saying that I can't be right about ever dealing with Sean (who handled after "Follies") or Arminda Trevino (who handled "Company" and "Follies")

But as I see, there is new Warner Chappell rep (Kurt Deutsch had around 2017 or so replaced Sean Patrick Flahaven, who knew me well in a very positive light, even knew "Last Starfighter," from the period where  all was riding very high for me and the LLC, before the inexplicable Jack stuff happened May 2013).

and it seems that under this rep,  or maybe his staff, copyright claims it seems even though there was prior approval, and I guess he did not know there had been prior approval back in 2009 or 2010...

and in any case, if it were known to the copyright holder or publisher that they knew about the new lyrics, the statute of limitations since 2009 or 2010 would be. long past.  It does not start over when the employee of Warner Chappell changes, of course, even if they have a different philosophy

Once you have to start proving things, it's no-win, of course.  it has  taken on a "Show me you're right" request from someone who would rather you not be right.  (in this case, Rick Pappas)

But I did have this email from Mr. Sondheim

From: Stephen Sondheim
To: FJL1960

Dear Fred Landau -
My apologies for not having replied sooner, but I've been away. Anyhow, I think your parody is fizzy and funny and fine (except for the "prefer/defer" identity), so you have my permission to use it on YouTube, but first you have to get permission from John Breglio. I'm sending him a copy of this reply. If you haven't heard back form him within a week, let me know.

Hi Fred,
Sorry for the delay. Steve has approved leaving the ALNM clips up as well as the “Chrysanthemum Tea” request.
Thanks,
Sean

Hi Fred,
Ah—I thought your name looked familiar. The different context and my sleep deprivation (our second son was born May 7; we also have a 2-year-old) made me forget temporarily.
Alli and I love Bill and Maureen, of course, and I do remember LAST STARFIGHTER.
I’ll try to get this done quickly.
Best,
Sean

so Rick Pappas was demonstrably incorrect.   And of course, no one ever likes being shows they made.a mistake..

and this from Mr. Sondheim showed totally that even at Nov. 2012, just months before the strange stuff that Jack did in May 2013

From: Stephen Sondheim
To: Fred Landau
Sent: Thu, Nov 8, 2012 10:55 pm
Dear Fred Landau -
The person you should ask permission of is Sean Patrick Flahaven at Warner/Chappell. His email is, not surprisingly, seanpatrick.flahaven@warnerchappell.com.
Your lyric is fun, although you had the same trouble with the last stanza that I did.
 Yours,
  Stephen Sondheim

my reputation was really very good.  None of the stuff  that Jack lied about starting in May 2013 (and still going on during Call Me Madam in January 2019)  remotely existed.  He'd made up a different Fred Landau and somehow Joann Landau had gotten involved then!!!

but it's no-win since showing someone who took such a strong dismissive stand doesn't improve their resistance to ever being helpful.

Yet you HAVE to prove they're wrong so they don't take action to remove your work online.
