It's a song known around the world; "Happy Birthday to You" is performed, heard, and played millions of times every day, but it's also a major moneymaker for Warner Music subsidiary Warner/Chappell, which owns the copyright to the song. Jennifer Nelson, a filmmaker who was producing a documentary on the song, discovered that to use the track in a single scene would cost $1,500. Although she agreed to the fee and signed a licensing deal, she's now filed a lawsuit in the hope that a New York court will invalidate Warner Music's copyright claim.
Nelson says that the song, which is an adaption of the 19th Century song "Good Morning to All," is in the public domain. A full copy of the filing, available at Techdirt, makes for entertaining reading. The lawsuit says that "irrefutable documentary evidence" dating back as far as 1893 shows that the copyright to any part of the song expired no later than 1921. It adds that if Warner Music "owns any rights to Happy Birthday to You, those rights are limited to the extremely narrow right to reproduce and distribute specific piano arrangements for the song published in 1935." The filing calls for the song to be made public domain, and asks that Warner Music pay back the millions of dollars it's collected through "unlawful licensing fees."

I've been wanting to revisit GIANT - the movie - for the longest time.I will probably do that, too, one of these days, but I'm listening to Michael John LaChiusa's score for the musical version. This is the most melodic score of his career, and also one of his best. Just loving it. Best score I've heard since "Eileen."
TOD:
I recorded BATHING BEAUTY yesterday off of TCM. The movie doesn't really interest me except for the fact that Basil Rathbone is in it. It's one of his that I've never seen.

I keep wanting to revisit the films of Esther Williams, and I often ponder why I don't have her films in my library.
And then it always slaps me in the face: Most of her films either have Van Johnson, or Red Skelton, or both. I cannot bear either for more than a few minutes at a time.
Thus, no Esther in my library.

What is going on today?
Wow, did she make that deal just to do this lawsuit?
no Esther in my library.

Well TCM is showing several of that big fat liar Esther Williams' films today....many of them w/o either Van or Red.... FIESTA is starting right now.
I like to watch her swimming movies....although I'm not convinced she did those HIGH dives herself.....

Perhaps I missed something: Why is Esther Williams a "big fat liar"?
I've only heard nice things about her.

Her book seems to have some untruths in it......according to those who were around at the time.....a lot of it was not true and manufactured to sell book.... It is a good book and she wasn't easy on herself either....and MOST of it was right on....she didn't need the sensationalism, I don't think.
She may have been a nice person.....but she certainly told some things about people no longer around to defend themselves....

Time to finish up this ROBERTA megillah. I'll meet Peter around 11am at Toyland, and we'll begin printing the orchestra parts. I'll tape the parts while he works at the computer. We can hopefully finish up the printing tomorrow. I'll be taping for several days.

I can't begin to imagine what DR Cillaliz is going through. I'd have to go stay in the Hampton Inn until it's over...
Leaves at dusk and comes back around 5:00 AM
What a scare, DR Cillaliz! Of course, you did the right thing.
I think your nerves must be a bit frayed at this point, what with all the goings on.
I had to look up "koozie." Who knew? :)
If you knew koozie,
Like I know koozie...
At first I thought those were spoolies.
SOOO as if the animal kingdom assault wasn't enough. Last night I woke up at 3:45, thinking I was hearing noises and saw Ricky very intent on a particular window. Thinking that I would see some beast outside I looked out the window and saw a man go in my neighbors window! WHAT!!! So I grabbed the phone and called 911. It took forever for the cops to figure out the house next to my address when there is only one house on my street next to my address with the main floor lights on at 3:45 AM. Anyway, my neighbors are out of town so I was really concerned. I did tell the 911 operator that they have a son and it could be nothing, but why would anyone be going in a window at 3:45 AM. I finally had to go outside and point to the house. There were three police cars and a K9 unit all parked outside my house, lol. Anyway, it must have been their son because they went to the door, talked to them and then left. So there I was at 4:15 AM wide awake.....

Greetings from Toyland!
I got here, stepped onto trhe elevator, pressed 10, and rode to 5, then the alarm began rining, I pressed 10 and got to 6 but the door didn't open, it just reversed and went back to the first floor. The elevator was also screwed up. I called Peter and advised him not to begin a trek to Manhattan until we knew the elevators were working. Ten minutes later I was in the office.
After I left the apartment, I stopped at the bank: my bank card has been cancelled because of suspected fraud.
What is going on today?
Good morning, all.
Nothing like starting the day with a little Betty Boop:

They stopped offering that service many years ago. I read the other day that overdraft and other fees account for something like 60% of the earnings for a bank.
Of course, if it is called an Angel Dump Cake, I should probably use chocolate pudding.
I'll just have the low-cal salmon tonight and pick at it.

DR Ron someone took great, super cute, baby photos of you. :)
Well if she's up in the attic, tell her to chase that raccoon into the trap.
Interesting how with new facts one's perception of a seemingly simple phone conversation can change.

It does feel like I'm being held hostage a little. The trapper called this morning and we are now doing a full on assault. He finally realized that we could put a trap on the ledge where the raccoon sits and taunts me and looks out over the neighborhood. We wired it to a downspout so it shouldn't come loose or fall. He now has 9 traps in my yard and has baited them with fresh fish, a sweet berry mixture, I think there's still cat food in one of them, and other stuff he usually uses. We also put a dish of water in the one on the ledge in case it is thirsty. I'm really hoping this works. It's definitely taken up residence. Leaves at dusk and comes back around 5:00 AM

Rita doesn't look pleased in that photo.....
Of course tomorrow is my trip to Ice Cream Days. I'll be gone from at least 11;00 to 4:30 or 5:00. I was going to go to the barbeque contest after we play, but I'm thinking I probably better get home and check the trap line. Those last 10 words are something I never thought I would ever utter

I meant to post this photo yesterday. It's the one I allude to up above - my fourth birthday and me sitting on steps with Rita Hammond.

DR CILLA LIZ - Venus and Pluto are both active this week and coming off the New Moon last Saturday, I am not surprised everything is in flux.....should calm down, but probably not until Tuesday or Wednesday.

Good afternoon. I spent the morning with my son having breakfast and running errands.
I'm feeling much better tonight. I know the coon is in the attic and probably won't leave tonight because of the weather, but I do think we're doing everything we can at the moment. The cats are much calmer since there isn't a wood chuck in a trap under the living room window like there was yesterday.

Thanks. I hope to, but since I declared this morning as not on a diet day, I'm thinking a burger, fries and a shake sound really good right now. May have to run out and get them and come back.

When I left the garage sale site, we'd made over $1000 and we had 90 minutes to go today and all day tomorrow. Prices drop to half at noon tomorrow and there are several items for which there will be fierce competition (if they're still there).

When I left for McDonald's my neighbor's son came running out to the road waving and smiling. I said "Was that you, last night?" He said yes and burst out laughing. He had missed his ride to join his parents at the flea market where they are selling antiques. He was staying there and had gone outside to get an old paper laying on the front step and got locked out. He finally was able to get the screen off and go in the window....that's when I saw him and called the police. He said he saw them coming and grabbed his ID so that he'd be able to explain. He said if he had seen me on the step he would have waved so I could tell them he was ok.
I said I wouldn't have called if I knew it was him. He said it was ok that I did. That mystery is solved
EW!!! :o
I was supposed to attend a concert tonight, but I'm playing hooky. I'm instead preparing for a solo appearance tomorrow night. I'm serenading a 95 year old woman (whom I do not know) at her family birthday party. She loves music, so they hired me to sing to her. Just me, no piano. :P
They asked for songs from the 1920s and WW II songs. Oh, and her favorite musicals are "Gypsy" and "1776." I suppose I'll do a medley of "Mama, Look Sharp," building to a climax of "Rose's Turn." :D
I'm awfully glad this will NOT be appearing on YouTube.

Today my sister would have been 69. It is sad I went from her adoring little sister to being relieved when she was gone. I like to remember her like this, before the abuse towards me was the norm and she was more often than not a wonderful big sister.

Mega vibes.
I need to find more time to do all the things i want to do. Maybe i will try to catch up this weekend if the weather is hot, i'm staying inside. Which is a good way to get things done.
Mega Saturday vibes.
Time to finish up this ROBERTA megillah. I'll meet Peter around 11am at Toyland, and we'll begin printing the orchestra parts. I'll tape the parts while he works at the computer. We can hopefully finish up the printing tomorrow. I'll be taping for several days.
